Terms of service
Terms and conditions
1. Scope and contracting party
These terms apply to consumer orders placed in our online shop. Your contracting party is:
VAMOYA GmbH
Zehntlandstrasse 7
9242 Oberuzwil
Switzerland
Email: info@vamoya.ch
WhatsApp: +41 77 282 28 50
Commercial register: CH-320.4.105.394-3 · UID: CHE-392.728.128
A consumer is an individual acting mainly for purposes outside their trade, business or profession. The ordering process and contract information are available in German, English, French, Italian, Spanish and Portuguese.
2. Orders and formation of the contract
Our product listings are an invitation to place an order. By submitting an order that requires payment, you make a binding offer to buy. You can review and correct your details before submitting the order.
We automatically acknowledge receipt of your order by email. This acknowledgement does not itself accept your offer. The contract is formed when we expressly confirm acceptance or dispatch the goods.
You receive your order details by email. You can save or print the applicable terms from this page before ordering.
3. Prices and payment
The prices shown when you order and the currency displayed at checkout apply. Product prices include applicable VAT. Shipping costs are charged separately unless the conditions for free shipping are met. For cross-border deliveries, please read the import-charge information in our shipping policy.
The payment methods available for your order and their conditions are displayed at checkout. Payment timing depends on the selected method; any advance-payment arrangement shown there applies. Payment providers' terms also apply when using their services.
4. Delivery
We deliver to the countries and addresses available at checkout. Shipping costs, delivery times and the shipping process are described in our shipping policy. A delivery period expressly agreed before the contract is formed takes precedence over general information.
If an ordered product is unavailable, we will inform you promptly. If delivery does not take place, we will refund payments already received. Statutory rights concerning delayed delivery are unaffected.
5. Retention of ownership
Where legally effective, goods remain our property until paid for in full.
6. Withdrawal and returns
Conditions, deadlines, return costs and the model withdrawal form are set out in our withdrawal and returns policy. For consumers in Switzerland, we offer the 14-day return conditions described there contractually; mandatory statutory rights are unaffected.
7. Legal guarantee
Statutory rights for faulty goods apply. Contact info@vamoya.ch if your goods are faulty. Information on EU legal guarantee rights is available in the overview of statutory guarantee rights.
Materials, care instructions and intended use are described for each product. Care instructions do not restrict statutory rights concerning faults.
8. Safety and liability
Working with horses involves risks. Check equipment for damage before each use and use it only as intended and in sound condition.
Our liability is governed by applicable law. Mandatory consumer and product-liability rights are unaffected.
9. Applicable law
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the EU, mandatory consumer protections in their country of residence and statutory jurisdiction rules remain unaffected.
10. Dispute resolution
We do not participate in proceedings before a consumer arbitration body unless legally required. Please address complaints to info@vamoya.ch.
